Unfortunately, there is nothing stopping them from grading the land.
They do not need any approvals to do this. As long as they are not constructing, they have a right to be there and operating anytime after 7 am.
I too wish that we could have some peace and quiet, at least once in a while. Maybe if they don't get approval soon, they'll run out of work to do, and we can enjoy the rest of the summer.
I awake to the sound of my cups clanking together EVERY MORNING except Sunday ... grrrrrr ... My guess is that they are doing their best to make as much noise and annoyance as possible. My concern is whether or not the dust that settles on my patio table is safe.
While the noise may be annoying at times, it's unlikely that the owner of the property would need any special permits to move dirt around on his own property (grading and cleaning up the site waiting for approvals to come through I'm sure) as long as he's doing it within the allowwed times.
I am shocked they are working EVERY day... I was not impressed this morning - Saturday!!
And for those who work shift work etc. I cannot imagine how frustrating it would be to try and sleep through the noise. Our house shakes...they are just pushing dirt around...
Is there anything we can do to get it stopped? At least until the permit goes through?
As long as they're only operating between 7 a.m. and 10 p.m. Monday to Saturday and they have mufflers on their equipment, the Town noise by-law apparently doesn't stop them from working.

If they do all the site prep now, they won't have to wait when the approvals do finally come through. Think of it from their perspective for a minute ... waiting years to get site approval from a system that takes far too long to get anything done and having a crew that needs to get paid, etc, etc.
My question is are they removing anything, dirt, block, etc? Just wondering because the builidngs are gone, I'm just wondering if they are now removing the steam tunnels that went from building to building. I went through some of the buildings when we first moved in 8 years ago. All the pipes in those tunnels were wrapped with asbestos, I would be concerned about what might be floating around.
I certainly can't guarantee their thoroughness but when they tore down the buildings a couple of years ago, they were meant to do all of the lead and asbestos removal then (in a safe and supervised manner) before all of the buildings came down. I think what they're doing right now is boulder/rock and old sewer removal.

I have sent an email off to Public works to answer such questions and concerns around:
1) Hours of operation and operation of the equipment
2) Approvals and preparation of land and what has been agreed upon.
3) Removal of steampipes and concerns of any asbestos removal.
I will send the information when I receive it.
